Welcome to Wildure B.V., these Terms and Conditions govern the use of our website https://www.wildure.nl and the purchase of products through our online store. By accessing or using our website, you agree to be bound by these Terms and Conditions. Please read them carefully.

 

1. General Provisions

1.1. Applicability These Terms and Conditions apply to all offers, agreements, and deliveries made by Wildure B.V. (hereinafter referred to as “we,” “us,” or “our”) through our website, unless explicitly agreed otherwise in writing.

1.2. Company Information Wildure B.V. is registered with the Dutch Chamber of Commerce under number 98064487 and is established at Lancasterdreef 28, 8251 TA Dronten, The Netherlands. Our VAT number is NL868344357B01.

1.3. Consumer Definition For the purposes of these Terms, a “consumer” is a natural person acting for purposes that are outside their trade, business, craft, or profession.

 

2. Offers and Agreements

2.1. Offers All offers on our website are non-binding unless explicitly stated otherwise. We reserve the right to modify or withdraw offers at any time.

2.2. Formation of Agreement An agreement is formed when you place an order through our website and we confirm acceptance of your order via email or other means. We reserve the right to refuse or cancel orders for legitimate reasons, such as product unavailability or suspicion of fraud.

2.3. Pricing All prices on our website are in Euros (€) and include VAT (BTW) unless stated otherwise. Prices exclude shipping costs, which will be clearly indicated during the checkout process.

2.4. Accuracy of Information We strive to ensure that all product descriptions, images, and prices are accurate. However, errors may occur. If we discover an error in the price or description of a product you have ordered, we will inform you as soon as possible and offer you the option to reconfirm the order or cancel it.

 

3. Right of Withdrawal (Returns)

3.1. Cooling-Off Period As a consumer in the Netherlands, you have the right to withdraw from the purchase agreement within 14 calendar daysfrom the day you (or a third party designated by you) receive the product, without providing a reason, in accordance with the EU Consumer Rights Directive and Dutch law.

3.2. Exercising the Right of Withdrawal To exercise your right of withdrawal, you must inform us within the 14-day period via email (contact@wildure.nl) or by using the Model Withdrawal Form available on our website. You must return the product within 14 days of notifying us of your withdrawal.

3.3. Return Costs You are responsible for the direct costs of returning the product unless we explicitly state otherwise.

3.4. Refund Upon receiving the returned product or proof of return, we will refund the full purchase amount, including standard shipping costs (if applicable), within 14 days. Refunds will be made using the same payment method used for the original transaction unless agreed otherwise. We may withhold the refund until we have received the product or proof of return.

3.5. Exceptions to the Right of Withdrawal The right of withdrawal does not apply to:

• Products made to your specifications or personalized items.
• Sealed products that are not suitable for return due to health or hygiene reasons (e.g., cosmetics, underwear) if the seal is broken.
• Perishable goods or goods with a limited shelf life.
• Digital content not supplied on a tangible medium if performance has begun with your prior consent.

4. Delivery

4.1. Delivery Times We aim to deliver your order within the estimated delivery time indicated during checkout. Delivery times are estimates and not guaranteed. If we are unable to meet the estimated delivery time, we will inform you as soon as possible.

4.2. Delivery Location We deliver to addresses within the Netherlands and other countries as specified on our website. You are responsible for providing accurate delivery information.

4.3. Risk and Ownership The risk of loss or damage to the product transfers to you upon delivery. Ownership transfers upon full payment of the purchase price.

4.4. Non-Delivery If you do not receive your order within the estimated delivery time, please contact us within 7 days so we can investigate and resolve the issue.

 

5. Payment

5.1. Payment Methods We accept the payment methods listed on our website, including iDEAL. All payments must be made in Euros (€).

5.2. Payment Terms Payment is due at the time of placing the order unless otherwise agreed. We reserve the right to suspend delivery until full payment is received.

5.3. Secure Payments All payments are processed through secure payment systems compliant with EU regulations.

 

6. Conformity and Warranty

6.1. Conformity We guarantee that our products conform to the agreement, the specifications stated in the offer, and the reasonable requirements of reliability and usability under Dutch law.

6.2. Legal Warranty As a consumer, you are entitled to a legal warranty under Dutch law, meaning that products must be free from defects. If a product is defective, you may be entitled to repair, replacement, or a refund, depending on the circumstances.

6.3. Additional Warranty If we offer an additional commercial warranty, the details will be provided with the product. This does not affect your statutory rights.

6.4. Complaints If you have a complaint about a product or our services, please contact us at contact@wildure.nl. We will respond to your complaint within 14 days of receipt and work to find a satisfactory solution in accordance with Dutch law.

 

7. Privacy and Data Protection

7.2. Purpose of Data Processing We collect and process your personal data solely for the purposes of processing your order, delivering products, handling payments, and providing customer support, unless you have given explicit consent for other uses (e.g., marketing).

8.2. Force Majeure We are not liable for failure to fulfill our obligations due to circumstances beyond our control, including but not limited to natural disasters, strikes, or government measures.

9.1. Ownership All content on our website, including text, images, and logos, is our property or used with permission and is protected by intellectual property laws. You may not use, reproduce, or distribute this content without our prior written consent.

 

10. Governing Law and Dispute Resolution

10.1. Governing Law These Terms and Conditions and any agreements with us are governed by Dutch law, with the application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) expressly excluded.

10.2. Dispute Resolution In the event of a dispute, we encourage you to contact us first to resolve the issue amicably. If a dispute cannot be resolved, it will be submitted to the competent court Rechtbank Midden-Nederland, unless you, as a consumer, choose within one month to have the dispute handled by the court of your place of residence.

10.3. Online Dispute Resolution (ODR) As required by EU law, consumers can submit complaints to the European Commission’s Online Dispute Resolution platform at http://ec.europa.eu/odr. Our email for ODR purposes is contact@wildure.nl.

 

11. Amendments to These Terms

We reserve the right to amend these Terms and Conditions at any time. Changes will be communicated on our website and, where applicable, directly to you. Continued use of our website after changes constitutes acceptance of the revised Terms.
